General Eligibility Criteria and Terms
The promotional offer described below (“Offer”) is available from March 1, 2017 to 11:59PM EST on May 31, 2017 and is available only to new merchants located in Canada that:
Limit one Offer per Merchant. The Offer is subject to change, withdrawal or cancellation at any time and is not valid with any other offer. The Offer does not apply to PAYD®, PAYD PRO®, or PAYD Pro Plus®.
Moneris is under no obligation to approve any applicant for any services, and reserves the right to determine a qualified merchant in accordance with its credit adjudication and other policies and procedures. Following satisfactory internal Moneris approval, Merchant will be required to agree to, and agree to be bound by, the terms and conditions of the Agreements.
Offer Details
Meet or Beat Rates
Merchant must provide Moneris with its MasterCard, Visa, Discover and Interac merchant processing statements for the last three months. The rate comparison for Moneris’ offer will be based on any of the rates (as determined by Moneris) for comparable services as set out in the processing statements provided. Rates comparison excludes any one-time or activation fees, terminal rental fees, assessment fees or other event-driven fees. Merchants currently participating in a merchant service program for franchisees, trade associations or member associations are not eligible for this Meet or Beat Rate offer. Merchants currently on interchange plus pricing are also excluded from participating in this Meet or Beat Rate offer. The comparison is valid as of the date statements from existing acquirer are provided by the merchant as compared to the offered Moneris rates. The Meet or Beat Rate Offer is subject to change, withdrawal or cancellation at any time and is not valid with any other offer.
General Details
90-day Satisfaction Guarantee
The 90-day satisfaction guarantee is limited to a waiver of the cancellation or deactivation fee if the Merchant cancels any of the Agreements within 90 days from the date of the Agreement. All other fees, charges and terms and conditions in the Agreements apply.
Limitations and Exclusions
Moneris, its officers, directors, employees, shareholders, promotion agencies, agents, successors, assigns and service providers will not be liable for any direct, indirect, incidental, special or consequential damages arising out of the Offer, even if advised of the possibility of such damages. By participating in the Offer, Merchant waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the incident upon which the claim or action is based. Merchant agrees that any and all disputes, claims and causes of action arising out of or connected with the Offer, shall be resolved individually, without resort to any form of class action.
By participating in the Offer, Merchant agrees to release and hold harmless Moneris and each of its parents, subsidiary, affiliate and related companies, and its and their respective officers, directors, employees, and agents from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Offer or resulting directly or indirectly, from acceptance, possession, use, or misuse of any item given in connection with the Offer.
Moneris may modify the terms and conditions as described above, and the most current version available on this page and will supersede all previous versions.
